Terms of sale

1. Seller and scope

These terms govern memberships for the digital content offered on thais-descufon.com by Escufon, LLC, 131 Continental Dr, Suite 305, Newark, DE 19713, United States.

Escufon, LLC operates the platform technically and commercially for Thaïs d’Escufon, the content creator. The company sells membership in its own name and supplies the access service. It manages memberships, billing and support and remains the member’s contracting party.

These terms apply to individuals subscribing for personal use. The version accepted when subscribing is retained with the order.

2. Content and access

Membership provides access to posts reserved for members: text, photos, videos and recordings when offered, as well as available discussion features. Publication frequency and topics may vary; no fixed number of posts or personal reply is guaranteed. Published opinions are not personalised professional advice.

Access is personal and requires an internet connection, a recent browser and an account linked to the subscription email address. No specific paid software is required. Members are responsible for their internet access costs.

3. Price and frequency

The monthly amount is selected before ordering, starting at €5. The total amount, currency, applicable taxes and payment frequency are shown before you commit to payment. The final amount displayed on the payment page takes precedence. Card memberships renew each month at the agreed amount until cancelled. With Monero, each payment covers 30 days without automatic renewal.

New paid memberships remain closed while tax configuration is being finalised.

4. Ordering and payment

You choose an amount, enter a valid email address, read these terms and confirm the conditions for the selected payment method. You may correct your details before final confirmation on the provider’s secure payment page, which states the obligation to pay.

Stripe processes full card details; the website does not store them. When Monero payments are available, you can purchase 30 days of access in XMR through NOWPayments, without automatic payments. The provider shows the XMR amount and any fees before payment. Access opens only after a complete payment matching the invoice is confirmed. Incomplete payments or payments in another currency require resolution with the provider and do not automatically open access. Each new confirmed payment adds 30 days to any remaining access, or starts 30 days if access has expired. Lifetime access is not offered.

5. Confirmation and account creation

Access opens after the provider confirms payment. Returning to the website from the payment page is not sufficient proof of payment. An email confirms payment and, if needed, lets you create your account password. The accepted terms and consent to immediate access are confirmed by email.

Keep your sign-in details confidential and report unauthorised access. An incorrect email address may prevent message delivery and must be corrected with the operator.

6. Duration and cancellation

For cards, membership renews monthly, without any further commitment beyond the paid period. You can stop renewal from My account using the cancellation button or billing portal.

For Monero, no future debit is scheduled: simply do not renew. For cards, cancellation takes effect at the end of the paid period and access remains available until that date. Cancellation alone does not refund a month already started. A confirmation states when access ends. If cancellation is unavailable, contact the operator before the next payment date.

7. Immediate access and right of withdrawal

Consumers generally have 14 days from entering into the contract to withdraw. For digital content supplied without a tangible medium, the law provides an exception where supply begins before that period ends following express prior consent, acknowledgement of the loss of the right of withdrawal, and confirmation of that agreement on a durable medium.

A separate, unticked checkbox records the request for immediate access and acknowledgement of that loss. Subscribing or accepting the terms alone is not a waiver. The loss of this right applies only under the statutory conditions and to supplies actually covered by this exception. If those conditions are not met, the statutory right remains available.

You can submit a request using withdrawal form. The form records your request; it does not determine its validity or automatically issue a refund.

8. Refunds and payment problems

No discretionary ‘satisfaction or your money back’ policy is offered. A change of mind, where the right of withdrawal has validly been lost, or voluntarily stopping use does not automatically entitle you to a refund.

This policy does not remove statutory rights, including in cases of non-conformity, failure to supply, incorrect billing or a legally applicable withdrawal right. The operator reviews justified requests; where a refund is due, it is made under the applicable legal procedures and time limits.

Failed payments or renewals may interrupt access. A payment dispute or fraud alert may result in suspension during review. These measures do not prejudge the member’s rights.

9. Statutory conformity guarantee for digital content and services

Escufon, LLC is responsible for the applicable statutory conformity guarantee for digital content and services, including Articles L. 224-25-12 et seq. of the French Consumer Code where applicable. For continuous supply, the guarantee covers defects arising during the contractual supply period.

Consumers may request that the content or service be brought into conformity free of charge, without unjustified delay or major inconvenience. In legally specified cases, they may obtain a price reduction or terminate the contract with the corresponding refund. Rules on the burden of proof and other mandatory rights remain applicable.

Updates necessary for service conformity and security are provided during the contractual period. You must use a compatible environment and follow reasonable update instructions. No additional benefit replaces statutory guarantees.

10. Use and moderation

Comments must comply with the law and respect other users. Threats, harassment, unlawful content, impersonation, spam and publishing private information without permission are prohibited. Comments may be moderated and discussion access may be restricted for serious or repeated abuse. Measures must remain proportionate and do not remove members’ statutory rights.

You retain rights in your contributions and authorise their display in the area where you post them, for the purposes of the service. Only share content you are entitled to publish.

11. Availability and changes

Maintenance, outages or security incidents may temporarily interrupt service. The operator seeks to limit interruptions and restore access. No clause excludes its statutory obligations to supply conforming content and services.

Substantial changes to prices or the offering are notified before they take effect. They do not retrospectively change an already paid period and allow you to stop future renewals.

12. Complaints and applicable law

First send complaints to Escufon, LLC, stating your subscription email address, the relevant date and the reason for your request, without sharing your full card number. Public contact details appear in the legal notice.

Access to the courts and mandatory consumer protections in your country of residence remain available. No clause imposes exclusive US jurisdiction at the expense of those rights. Details of the competent mediation service must be completed before commercial opening.
